Additional Information: Commercial Auto Liability Coverages - The Commercial Auto Liability Coverage provides protection against legal liability arising out of the ownership, maintenance, or use of any insured automobile. The insuring agreement agrees to pay damages for bodily injury or property damage for which the insured is legally responsible because of an automobile accident resulting from the ownership, maintenance or use of a covered auto. The insuring agreement also states that, in addition to the payment of damages for which the insured is legally liable, the insurer also agrees to defend the insured for legal defense costs. The defense costs are in addition to the policy limits. Liability Coverage - Type of insurance that protects an insured from financial loss arising out of liability claims by transferring the burden of financial loss from the insured to the insurance company. Non-Trucking Liability - Commonly referred to as Bobtail Liability Insurance. Non-Trucking Liability is coverage for an owner operator leased out to another carrier or trucking company. This is coverage for an owner operator while not under dispatch. This is for the owner operator acting upon his own actions and not the leasing company's. The leasing companies liability coverage is not in the owner operator's name. Non-Trucking coverage give the owner operator liability coverage in his name. Bobtail Liability - See Non-Trucking Liability. Commercial General Liability Coverage - The Commercial General Liability Policy provides insurance protection needed to pay damages for bodily injury or property damages for which the insured is legally responsible. The policy provides coverage for liability arising from personal injury and advertising injury. Medical expense coverage is provided. The policy covers accidents occurring on the premises or away from the premises. Coverage is provided for injury or damages arising out of goods or products made or sold by the named insured. The insured is the named insured and the employees of the named insured. However, several individuals and organizations, other than the named insured, may be covered, depending upon certain circumstances specified in the policy. In addition to the limits, the policy provides supplemental payments for attorney fees, court costs, and other expenses associated with a claim or the defense of a liability suit. Reasons For Truckers To Buy General Liability Underinsured Motorists Coverage - This coverage is commonly paired up with Uninsured Motorists Coverage. This coverage comes into effect in an accident where another party's liability limits will be used to cover the insured's loss of bodily injury or property damage. If the other party's limits of liability are found to be insufficient to cover damages inflicted to the insured. The Underinsured Motorist Cover will cover the difference between the other party's insurance limits and the damage inflicted to the insured. Excess Liability - This policy normally overlays a $1,000,000 limit of liability over the trucker's primary limit of liability. These excess liability polices can be layer up to 5 or 10 Million limits of Liability Coverage. Physical Damage Coverage - This is coverage for a covered auto if it strikes or is struck by objects inflicting damage to the covered auto. There are three forms of Physical Damage Coverage, which include the following: Collision, Comprehensive, and Specified Causes of Loss or Specified Perils. Collision - Coverage provides protection against loss or damage to a covered auto or a non-owned auto resulting from the impact with another vehicle or object. Collision losses are paid regardless of fault. Specified Causes of Loss - Provides coverage against loss from fire, lightning, explosion, theft, windstorm, hail, earthquake, flood, mischief, vandalism, and sinking, burning, collision or derailment of a conveyance transporting the covered auto. Comprehensive Coverage - Coverage provides protection against loss or damage to a covered auto resulting from loss other than collision or upset. This coverage also provides supplemental payments for transportation expenses in the event of total theft of a covered auto or a non-owned auto. Coverage begins forty-eight hours after the theft . Motor Truck Cargo Liability - This policy is "Liability" coverage for the insured as a motor carrier for "Loss" to "Covered Property (Cargo)" caused by any of the Covered Causes of Loss for a covered "auto" as described in the declarations of your Motor Truck Cargo Policy. Covered Property - Means lawful goods and merchandise in your "Care, Custody, and Control", to which you are legally liable under a "Bill of Lading", "Tariff Documents", or "Shipping Receipts". It is very important to check your policy for specific coverages and exclusions - as these vary from company to company. Contingent Cargo Coverage - This policy is primarily coverage for Brokers. Brokers receive "Certificates of Insurance" from truckers to ensure that they have coverage in place for the cargo to be transported. If the cargo policy on the certificate does not respond to a loss; the Broker could be held responsible for the good in transit. Contingent Cargo Coverage comes into effect when the hired trucker's Cargo insurance does not respond to an accident. This coverage is "Contingent" coverage for brokers. Insurance Filings - This is the most important thing to a commercial auto policy. Filings are written documents to the Federal & State Agencies guaranteeing coverage of insuranceThe Filings are documentation to the government agencies that states "All Owned or Operated Equipment is Covered By the Insurance Company Making the Filing". Because of this filing the insurance company requires to cover all " Owned or Operated" equipment since they have guaranteed coverage to the Government agencies. To Cancel filings it Normally require 35 day written notice of cancellation. Authorities - There are only three different types of authority: Common, Contract, and Broker authorities. Common Authority - This authority provides for-hire truck transportation to the general public. Common Carriers must file both liability (BI & PD) insurance and cargo insurance. Contract Authority - This authority provides for-hire truck transportation to specific individual shippers. Contract carriers file only liability (BI&PD) insurance. Broker Authority - This authority is for a company who, for compensation, arranges for the truck transportation of cargo belonging to others, utilizing for-hire carriers to provide the actual truck transportation. Brokers must file either a surety bond or trust fund agreement. Interstate - Interstate commerce is trade, traffic or transportation involving the crossing of a State boundary. Intrastate - Intrastate commerce is trade, traffic or transportation within a single State. |
